    i had a case where i owned a 15 year old

car that was low milage and in perfect shape and was hit while parked. after their ajuster looked at the car the body shop owner called me and said he thinks they will total the car. i told him to fix it and i would pay. 2 weeks later after i had the repaired car back in my garage their adjuster came and said they were going to total my car. i told him he was too late because i already had it repaired. he said who gave me the permission to have the work done and i said i did not need anyone permission because it was my car. they paid up.

Diminished value is very difficult to prove. You have to prove your loss in any insurance claim. The policy wordings also differ for different Insurers. If you feel you have a diminished value claim I recommend you involve your professional Insurance Broker from the start.

        Re: Diminished Value claim

I agree - every agreed-value collector policy I've reviewed specifically excludes any coverage for "diminution of value".

Sorry to see your mishap. I see at least 3-5 collisions a year where a person turns right in front of a Corvette.
Look at this link. It may make you feel a little better to know that there are others who have been through a similar situation.

The idiot 'best man' in the white mustang backed out of a driveway completely blocking both lanes as I was driving by. Later told police and insurance that he couldn't see anything so he asked the 'ushers' if the road was clear. I stepped over the crying bride to be and her flowing dress as I called for the police.

I have felt your pain! Fortunately I had a stash of original black glass top surround, inner fender and spare hood. Got a new radiator bumpers and grille straightened out just fine. A******e drove his mustang to Florida on his honeymoon the next day.

Never travel without your camera!!!! Also got shots with both cars in position.
Dealing with his insurance company required the state of NJ Div of insurance, Dept of investigation to step in and make these guys come around. You would not believe how insurance companies rip people off but nobody ever talks about the fraud they perpetrate on consumers.

                Clem -

Nope, pertains to any damage, however inflicted - the insurers don't recognize "diminution of value" at all; if it's repaired to the state it was in before it was damaged, that's their only liability.
