    Jacob,

If you notified your credit card company of the problem(dispute) within the allowed time frame, which I think is what you've said, email me and I can help you provide them with the information they'll need to find in your favor and issue you credit for the purchase. I've had 100% success with the disputes I have been forced to file.

.....proof of return, which you already have, and information showing the exact merchandise you ordered was not what you received are the important things for the credit card company.

I'm not sure I would rely on the numbers Leanne gave you. You'd be better off IMO to use your own tracking number when you returned the heads

You need to see Vito about this. He's got a big ugly guy from South Side Chicago, collections are his specialty. E-Mail me I will give you his number.

I'm sorry, but I'm not even going to bother

reading all of the messages above; that's because it was a REPLAY of my situation in the mid-'90's - Tonawanda instead of Flint, etc. To this day, I think my salvation was that I had purchased the heads through a Driveline ad. When I wrote to bitch via Certified Mail - Return Receipt, I copied John Amgwert. I cannot testify to this because he did not tell me, but a Chicago Corvette empoyee later told me that JA had called CC and gently informed the owner that if this was not corrected, CC's ad would be "lost in the mail" for the next two years. I had my $$$ in six days.

                  Thanks soooo much everyone!!!!!

Everone of you have been so helpful. I made some good progress today, but at the end of the day I still don't have my money back.

I forgot to tell them to send me a cashier's check.... Leanne isn't that friendly anymore, and I actually had to remind her to put herself in my shoes.... she didn't like that comment, I tried to explain that if I (the victim here ) hadn't been rude or lost my cool yet, then where did she get off being so rude to me! What a joke!

She gave me a auth# and a batch # and a phone # to call. I spent 2 hours on the phone with the # she gave me, and finally was told that they don't even have the information I am seeking. Of course this all ended up at the end of the day, after hours.....

immediate salvation..... a big fat cruise in my 435 Roadster!!! It was the first Sunny day I have seen in over a week!

Tomorrow I have an appointment with the Credit Card Dispute Line, I will keep you all informed!

                  Thanks again for your help!
                  God Bless the NCRS!

                  Best Regards,
                  Jacob Angel

                      Re: Thanks soooo much everyone!!!!!

I debated getting inmto this issue, but here goes.

You can definitely file a dispute with the credit card company. They will almost certainly issue you a TEMPORARY credit for the disputed anount. They will then contact the vendor and ask them to work it out. The vast majority of vendors will try to resolve it at this point.

However, there is nothing to force the vendor to resolve the issue. If the vendor flat refuses to resolve the issue, the money is returned to them by the credit card company, and you will be told by the credit card company that your only option is to persue the matter through legal channels.

The issue here is that most companies don't want to risk their relationship with the credit card company, so they resolve the issue.

I had an issue a year ago where the company just refused to resolve it. The owner was mad because I filed a complaint with the BBB. He said he didn't care if VISA stopped allowing him to accept charge cards.

Credit Card chargebacks have skyrocketed in the last few years, which has prompted a number of credit card companies to make this process more difficult.

Best of luck in your situation.

                          Jacob,

You can also advise big Al that you will turn him in to the Illinois State Police and start a fraud case against him. In addition, you can file a small cliams up to $3500 (should cost about $30 to file). Also advise him you will write a letter to the State Attorney Generals office and the Better Business Buerau and essentially it will open up a can of worms on this jerk that is long over due. Make sure you send letters with facts only, the Govenment Offices have to respond to you if you submit in writing.

                          Good luck.

The way it USED to work in Illinois was that you could sue in small claims court. Something like this should be an easy win. Then at the end of 30 days after judgement, if the company had not paid, you could arrive with a deputy, serve them, and if they didn't pay right then, you could have the deputy sell any items at the business until the judgement was paid.

Small claims was a minimum cost way of going to court, and the fees for having the deputy serve the loser were small.

I would think that showing up as he does business at Bloomington Gold or one of the Chevy/Vette Fest shows, if you timed the court right, would add even more impact as it would be right in front of all his customers.

Like I said, it used to work that way. A lot has changed in the 30 years since I had to go through that. You might want to check with a lawyer in Illinois to see if you still can.

Remember, it isn't enough to win in court, you have to actually get him to pay the judgement in the end.
