I've seen this before and often wondered if our organization has any recourse with these individual(s). Maybe it just something we do not have to time or finances to throw away at this, as our members have way more serious things to be working on that further the organization. I have also seen the T-shirts and sweatshirts before on ebay, most likely originating from the same place. Didn't ebay remove the ads where someone was selling counterfeit early Restorer magazines?

Realistically they are not infringing on copyright. The image is not an exact reproduction and would not be considered a violation. No I am not a lawyer but I am an officer in a club who's patch is also trade marked and we have had similar issues with copy cat items. Upon review we found that enough of our image had been altered to consider it a new and unique item as far as the law was concerned and could not receive copyright protection. So we had to go old school and lean on them to stop, ahh democracy in action. So if any of you guys want to saddle up and put a crew together you may have some recourse otherwise forget about it and laugh it off.- Top

I thought about all of that. If I was to receive the support of some of the membership, I might be "that guy", but I don't really know where to start right off the bat. Any ideas? I am sure the guys that know me well would agree that, I am one of "those guys" that has a way of getting under peoples skin when I have a mind to, and they will do just about anything just to make me "go away". I am not certain all this converstion has a place on this board, so if someone wants to send me a private communication with some ideas, I have a little time I will throw at it. I do know from my own ebay experiences that you have to be very carefull with communication that goes through their system, but I am fairly well versed in this also. I might find it to be somewhat "fun" to give them the business, if you know what I mean!!

He is infringing on General Motors copyright of the flags. NCRS can only use these flags with GM's permission.
This idiot has been warned by GM and NCRS's lawyers before. He has been banned from the CF, has had his items removed from ebay, etc. He thumbs his nose at everyone. He basically has no assets so what would you get from suing him?Dick Whittington- Top

At the possibility of making myself look like to big of an A******, from what you say, I can assure you that all the lawyers in the world cannot be as big of a pain as me. They have ethics and guidelines that get in the way. I do not. I'm going to log onto ebay right now and send something to them, just because I can. They know me very well, I do NOT go away easily, and I enjoy giving them the business from time to time anyway.

I have just reported it if someone had not done so already. I also send a direct communication to ebay themselves with a short note, and will be waiting for their response. After the spelling thing yesterday, and to keep in line with my earlier statement that this may not be technical discussion, I was going to paste in the note I sent, but again maybe this is not the place. If anyone is intersted in what I wrote, please contact me privately or someone let me know I can post this here.

Is anyone sure this IS the same guy? I do see he has NO feedbacks as a seller, so maybe same guy/new or different identity. Just want to have a few facts straight if I am going to attempt to communicate with ebay on this.

Wow!! I look at this a little differently. This "ripoff" is bringing attention to an industry standard. Recognizing the attention to detail and perfection along with all the great attributes that NCRS brings to the table. I talk to at least 2 people everyweek that have no idea what NCRS is, their mission statement nor their commitment to the hobby. This negative advertising "will" inform/educate the public and how many times have you been at a car show or meet and heard someone say yes but its not NCRS without really even knowing what they are talking about?
Yes its wrong and yes it upsets me slightly, but it does educate the public about our orgainzation.

After a little research, this is not the idiot in Florida. The seller has apparently had some made. The legal eagles are on it at this time. If you do not actively protect your copyright or patent, it is basically worthless. Case in point, Aspirin. Google the historyDick Whittington- Top
